Southern Surplus Terms and Conditions

These Terms and Conditions apply when purchasing products from, selling materials to, or using the services of Southern Surplus Ltd. By placing an order, accepting a quotation or agreeing to sell goods to us, you agree to these terms.

1. About Southern Surplus

Southern Surplus Ltd buys and sells surplus building materials, appliances, commercial vehicles, tools, plant and machinery throughout the UK.

2. Products and Availability

Our stock may include new, surplus, clearance, discontinued, reclaimed and previously used products. The condition of individual items will be stated in the product description or explained before purchase.

Because much of our stock is purchased in limited quantities or job lots, all products are subject to availability. Placing an order does not guarantee stock until the order has been confirmed by Southern Surplus.

Photographs are provided as accurately as possible. Colours, grain, dimensions, packaging and appearance may vary, particularly with timber, reclaimed materials and used products.

3. Prices and Payment

Prices will be displayed on our website, advertisement, invoice or quotation. Any applicable delivery charge will be confirmed before an order is completed.

Payment may be accepted by cash, bank transfer, card or another method agreed in advance. Goods remain the property of Southern Surplus until payment has been received in full.

We may correct genuine pricing or description errors before accepting an order. If payment has already been taken, the customer may accept the corrected price or receive a full refund.

4. Discounts and Special Offers

Discounts, promotional prices and bulk-buying offers are subject to availability and may be changed or withdrawn at any time before an order is confirmed.

Unless stated otherwise, promotional codes and discounts cannot be combined. Discounts have no cash value and cannot be applied retrospectively to completed orders.

Reduced or sale items retain the same statutory consumer rights as full-price goods.

5. Delivery

Southern Surplus provides fast delivery within approximately 70 miles of Portsmouth. Delivery outside this area may be available by prior arrangement.

Any delivery date or time is an estimate unless confirmed in writing as guaranteed. We are not responsible for delays caused by traffic, weather, vehicle breakdowns, supplier delays or other circumstances outside our reasonable control.

The customer must provide safe and suitable access to the delivery address. Unless agreed otherwise, delivery is made to the nearest safe and accessible point. Our drivers are not required to carry materials through buildings or across unsafe ground.

Additional charges may apply if delivery cannot be completed because of restricted access, an incorrect address or nobody being available to receive the order.

6. Checking Your Delivery

Customers should inspect their order as soon as reasonably possible and report missing, damaged or incorrect goods promptly.

Natural movement, knots, colour variation, grain differences, minor splits and reasonable dimensional tolerances may occur in timber and are not necessarily defects.

Nothing in these terms limits a consumer’s legal rights where goods are faulty, not as described or unfit for their intended purpose.

7. Cancellations and Returns

Consumers purchasing online, by telephone or through another distance-selling method will normally have 14 days after receiving their goods to notify us that they wish to cancel. They will then have a further 14 days to return the goods.

Returned goods should be kept in reasonable condition. Unless the goods are faulty or incorrectly supplied, the customer is responsible for the cost of returning them.

Cancellation rights may not apply to goods that have been cut, altered, made to measure or specially prepared to the customer’s requirements.

For purchases made in person, we are not required to accept a return simply because the customer has changed their mind. This does not affect the customer’s rights concerning faulty or misdescribed goods.

Business-to-business returns are accepted only with our prior agreement, except where the goods do not meet the agreed description or other legal rights apply.

8. Used Goods, Appliances, Vehicles and Machinery

Used, reclaimed and surplus products are sold according to their stated age, condition and description. Normal signs of previous use are not considered faults where they were disclosed before purchase.

Customers should satisfy themselves that commercial vehicles, appliances, tools, plant and machinery are suitable for their intended use. Any warranty or guarantee will be clearly stated at the time of sale. No additional warranty should be assumed.

Nothing in this section removes any rights that cannot legally be excluded.

9. Selling Materials to Southern Surplus

Anyone offering materials, vehicles, plant, machinery or other goods to Southern Surplus confirms that:

* They own the goods or have full authority to sell them.
* The goods are not stolen, subject to finance or owned by another party.
* All descriptions, quantities and photographs provided are accurate.
* Any known faults, damage, contamination or hazardous materials have been disclosed.
* Safe and reasonable collection access will be provided.

Our offer may be revised or withdrawn if the goods differ materially from their description, photographs, stated quantity or condition.

Ownership transfers to Southern Surplus once the agreed payment has been made and the goods have been collected, unless agreed otherwise in writing.

10. Limitation of Liability

Southern Surplus does not exclude liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or breach of statutory consumer rights.

We are not responsible for losses caused by incorrect installation, misuse, unsuitable storage, unauthorised alterations or failure to follow appropriate instructions and safety requirements.

Customers remain responsible for checking that products are suitable for their intended project and comply with any relevant planning, building, installation or safety requirements.

11. Website Information

We aim to keep the information on our website accurate and current, but stock, prices, descriptions and availability may change without notice.

Website content is provided for general information and should not replace professional building, structural, electrical, mechanical or installation advice.

12. Privacy

Personal information is processed in accordance with our Privacy Policy. We only use customer and seller information for legitimate business purposes, including processing orders, arranging collections and deliveries, handling enquiries and meeting legal obligations.

13. Changes to These Terms

We may update these Terms and Conditions when our services, business practices or legal requirements change. The terms that apply to an order will be those available when the order is accepted.

14. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Consumers retain any mandatory rights relating to the courts available where they live.
